NOTICE OF ADOPTION OF RESOLUTION
APPROVING CONTRACT WITH GREVER & WARD, INC.
FOR THE LAYING OUT OF 168 CREMATION PLOTS
AND PREPARATION OF SALES MAP
IN THE CHICHESTER CEMETERY
SUBJECT TO PERMISSIVE REFERENDUM
NOTICE IS HEREBY GIVEN that at a regular meeting of the Town Board of the Town of Bedford, held on May 16, 2023, the Town Board of the Town of Bedford duly adopted a Resolution which, among other things, authorized the Town Board to enter into an agreement with Grever & Ward, Inc. to lay out 168 cremation plots in the Chichester Cemetery located on Old Corner Road in the Town of Bedford (the “Contract”). The cost for the services to be provided under the contract is $8,850.00. In addition, under the Contract Grever & Ward will prepare a sales map at a cost of $1,100.00, for a total cost of $9,950.00.
Pursuant to Section 291, Subdivision 3 of the Town Law of the State of New York, If the expenditure for improvements to a Town operated cemetery is in excess of $1,500.00 and is to be paid by taxes levied for the fiscal year in which such expenditure is to be made, or paid from the proceeds of town obligations, the adoption of any such resolution authorizing such improvements shall be subject to a permissive referendum.
The Resolution approving the Contract is subject to a Permissive Referendum pursuant to State of New York Town Law §§ 64(2), 90 et seq. and 291(3).
The Resolution approving the Contract, further authorizes the Town Supervisor to execute the Contract, subject to final review by the Town Attorney, and to take any other actions necessary to effectuate the terms of the Contract, if within thirty (30) days of the publication of this Notice of Resolution a duly authorized petition is not filed with the Town Clerk pursuant to NY Town Law §90, and the proposed work under the contract may proceed.
If, within thirty (30) days of the publication of this Notice of Resolution a petition meeting the requirements under NY Town Law §90 is filed with the Town Clerk protesting the sale of the Property and requesting that it be submitted to vote, then the Town of Bedford shall have the option not to proceed with the Contract; or if the Project is approved by majority vote of qualified electors of the Town of Bedford, then the Town Supervisor shall be authorized to execute the Contract, subject to final review by the Town Attorney, and to take any other actions necessary to effectuate the terms of the Contract.
