DISCUSSION OF TIME EXTENSION:

Section-Block- Lot: 49.19-1-9; Residential Quarter Acre Zoning

The applicants are seeking a time extension of ZBA Resolution #06-22 Four which granted a variance for the construction of an underground two-car garage and workshop into the existing hillside connected by an underground link from the resident’s basement level to the workshop where the pre-existing, non-conforming covered front porch front yard setback is 24.31' where 35' is required; and where the new two-car garage will result in a front yard setback of 24.31' where 35' is required and a side yard setback of 7.5' where 15' is required in the Residential Quarter Acre Zoning District; and where the combined side yard setback will result in 28.7' where 35' total both sides is required. The construction of an underground workshop will result in a rear yard setback of 38' where 40' is required in the Residential Quarter Acre Zoning District in accordance with     Article III Section 125-11D and Article V Section 125-50 and where the applicants were to use their best efforts to ensure that a building permit is issued within eighteen months and to diligently pursue such construction to completion.

The applicants are seeking a time extension of ZBA Resolution #11-22 Six granting a variance for the construction of a two-story addition off the rear west side and an open areaway with steps off the south side of the house on a pre-existing, legal, non-conforming lot where the lot size is 7500 sq ft where 10,000 sq ft is required  in the Residential Quarter Acre Zoning District; and where the lesser side yard setback exists at 5.7'' where 15' is required and where the combined side yard setback results in 18.46' where 35' is required in the Residential Quarter Acre Zoning District. The existing building coverage is 17.73% and will result in 20.80% where 20% is the maximum permitted for building coverage and where the existing impervious surface is 39.37% and will result in a total impervious surface of 41.27% where the maximum allowable coverage is 40% in the Residential Quarter Acre Zoning District in accordance with Article III Section 125-11D and Article V Section 125-50 and where the applicants were to use their best efforts to ensure that a building permit is issued within one year and to diligently pursue such construction to completion.

The applicant is requesting an amendment to the existing Special Use Permit, in accordance with Article VIII Section 125-74(C & E), granted to Revolutionary Road Properties LLC on September 7, 2023, Resolution #09-23 One, to include seasonal events such as pumpkin painting, Easter Egg Hunt, Christmas Wreath Making, Floral Arrangement Classes, and Vegetable Garden Lessons/Seminars in the Residential 2-acre Zoning District and to construct a new sales building, greenhouse and pergola, where the greenhouse structures total floor area results in 2973 sq ft where a maximum of 1500 sq ft is permitted for a landscape nursery in the Residential 2-Acre Zoning district; and to erect a Type C free-standing sign resulting in a front yard setback of .25’ where 15’ is required for a landscape nursery in the Residential 2-Acre Zoning District. The applicants are requesting a variance to permit a two-story addition to convert a legal, pre-existing garage into a media room with a guest suite and to construct a one-story media link addition to a pre-existing, legal, nonconforming residence which creates an increase in the dimensional nonconformity of the residence and where the media link side yard setback results in 32.87’ where 50’ is required and where the media room/guest suite side yard setback results in 11.2’ where 50’ is required in the Residential 4-Acre Zoning District; and for the construction of a new one-story, detached, three-car garage where the front yard setback results in 51’ where 75’ is required and where the side yard setback results in 26.11’ where 50’ is required in the Residential 4-Acre Zoning District; and where the total building coverage results in 4.45% where the existing building coverage is 3.59% where a maximum of 3% building coverage is permitted in the Residential 4-Acre Zoning District. The applicant is requesting a variance to permit the construction of additions to a pre-existing, legal, nonconforming barn, on a legal, nonconforming lot with a lot size of 78,408 sq ft where 174,120 sq ft is required in the Residential 4-Acre Zoning District and where the gross floor area of the barn results in 1520 sq ft or 19.39% of the area of the lot which exceeds the permit maximum of .5% or 392.04 sq ft in the Residential 4-Acre Zoning District; and where the building coverage results in 4.16%, where 2.95% currently exists, and where 3% is the maximum building coverage permitted in the Residential 4-Acre Zoning District.
